1. Acceptance of Terms

By accessing or using KitchenProof(the "Service"), operated by Palms AI, LLC ("we," "us," or "our"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

KitchenProof is field-service operations software for restaurant compliance service companies. The Service may include customer accounts, locations, recurring service requirements, route planning, field checklists, photos, deficiency tracking, compliance reports, customer portals, quotes, invoices, payments, analytics, and related tools.

3. Compliance Documentation

The Service helps organize service records and proof packets. It does not provide legal, engineering, fire-code, health-code, insurance, or AHJ certification advice. You are responsible for reviewing reports, local requirements, customer obligations, and any required professional judgment before sharing documentation.

4. User Accounts

You are responsible for maintaining your account credentials, the accuracy of your business and customer data, and all activity under your account.

5. Acceptable Use

You agree not to use the Service for unlawful purposes, attempt unauthorized access, interfere with the Service, abuse public forms or portals, upload unlawful content, or copy, modify, resell, or distribute the Service without our written consent.

6. SMS and Email Communications

If messaging features are enabled, transactional SMS or email may be sent for service requests, confirmations, reminders, report delivery, quotes, invoices, and account notices. You are responsible for collecting and honoring any customer consent required for your use of these features. STOP replies sent through SMS are honored automatically when supported by the messaging provider.

7. Billing

Pilot and subscription pricing may vary by agreement. Any paid plan, usage fee, payment processing fee, cancellation term, or renewal term will be communicated before charges apply.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Palms AI, LLC and protected by applicable intellectual property laws.

9. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Palms AI, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

1. Information We Collect

We collect information you provide directly, including account information, business information, team information, customer account records, restaurant locations, contacts, service requirements, asset records, appointments, checklists, photos, deficiencies, reports, quotes, invoices, payment status, messages, and support communications.

If you choose to import contacts, the app reads only the contacts involved in that import and stores the selected information as customer or contact records in your account.

If arrival verification is enabled, the app may record a single foreground location reading when a crew member taps Clock In at a job. Customer addresses may be geocoded so routes can be planned.

2. How We Use Information

We use information to provide and maintain the Service, authenticate users, schedule work, plan routes, create reports and proof packets, manage portals, process quotes and invoices, deliver transactional communications, improve the Service, and respond to support requests.

3. Data Storage and Security

We use commercially reasonable safeguards, encryption, access controls, and row-level data isolation where supported by our database provider. No system can be guaranteed perfectly secure.

4. Data Sharing

We do not sell your data. We share data only with providers that help operate the Service, such as database hosting, authentication, application hosting, payment processing, email, SMS delivery, geocoding, analytics, and support tools, or when required by law.

5. Customer and Report Data

Customer, restaurant, asset, report, deficiency, quote, invoice, and portal data entered by your business remains your business data. You are responsible for ensuring you have the rights and consent needed to store, process, and share it.

6. Data Retention and Deletion

We retain data while your account is active or as needed to provide the Service, meet legal obligations, resolve disputes, and enforce agreements. You can request deletion from the app or from our account deletion page.

7. Your Choices

You may access, correct, export, or request deletion of your information where supported by the Service and applicable law. You may also opt out of non-essential communications.

8. Cookies

We use essential cookies and similar technologies for authentication, security, and session management. We do not use third-party advertising cookies.
